What to do if snow, ice or an icicle falls on your car? What to do if you don’t have CASCO, how to find the culprits and what you need to know to get compensation for a broken car. First of all, it is important to find out who owns the building from which the icicle fell, damaging the car. There may be several options: 1️. If this is a building of a government agency/organization (hospital, public service center, court, etc.), then the government agency/organization located in it will be responsible for the damage; ⠀ 2️. If this is the building of a private company (bank, store, any other company), this organization must compensate for the damage; 3️. If this is a residential building, then depending on the form of management of the condominium property, it can be a management company, OSI (KSK) or a simple partnership - all of them bear responsibilities for managing the condominium property and are responsible for damage caused to you. Algorithm of actions: • Call the local district police officer (not the traffic police) to draw up a report on the fact of damage to property. • If you have CASCO or another type of voluntary auto insurance, be sure to call an accident commissioner. • Conduct an independent assessment of the damage to the car from an appraiser (pre-notify interested parties of the need to attend the independent assessment (indicate the date, time and place of the assessment). • Draw up and present to the owner of the building a pre-trial claim in two copies describing the situation and demanding compensation for damage on a voluntary basis, attach copies of the assessment, protocol (incident materials). • On one copy, stamp the incoming correspondence with the date and name of the recipient and take it for yourself. The second copy should be left with the owner of the building. • In case of refusal, prepare and send a claim for damages to the district court at the location of the owner of the building.
